David W. Edgar is one of the founding partners of Edgar Law Firm. He, along with John M. Edgar and John F. Edgar, started the firm in 2002 in order to provide the legal solutions for clients' business problems, especially when it comes to high-stakes and complex litigation. He practices in the areas of complex commercial litigation (including business torts, fraud, franchisee-franchisor disputes, trade secret litigation), environmental litigation, toxic tort litigation, antitrust litigation, class and derivative actions, securities litigation, construction litigation, labor and employment litigation, and property litigation.

David was born and raised in the Kansas City area. He honed his litigation skills early in his career in plaintiff and defense work for individuals and companies of all sizes as an attorney with Bryan Cave (currently more than 1,275 lawyers internationally). David is a graduate of Gerry Spence's Trial Lawyer's College in Dubois, Wyoming.

David and his wife, Andrea, and their three children, Shannon, David Jr. and Aisling, live in Evergreen, Colorado. Outside of his work on behalf of clients, David enjoys devoting time to family and church, reading and writing fiction, fly fishing, playing guitar and banjo, and working to preserve the environment in the Midwest and Rocky Mountain West.

Recent Representative Cases

Ethanex Energy, Inc. v. McGuireWoods, LLP. David and the Edgar team represented the bankruptcy trustee of a development-stage renewable energy company, Ethanex Energy, Inc., engaged in the development of ethanol production facilities. Defendant McGuireWoods, LLP, is a Richmond, Virginia, based major law firm with offices in the United States and Europe. Ethanex engaged McGuireWoods to accomplish an equity financing and reverse merger, known as a PIPE (private investment in public equity) transaction. Unbeknownst to Ethanex, McGuireWoods partner Louis Zehil, was utilizing his position to perpetrate a scheme to fraudulently trade in restricted securities. Zehil subsequently pled guilty to criminal charges and was sentenced to the federal penal system. The Edgar team filed suit against McGuireWoods, with causes of action including fraud, tortious interference with business expectancies, legal malpractice, negligent supervision and breach of fiduciary duty. As a result of McGuireWoods’ misconduct, Ethanex alleged that it was unable to carry out its business plan, resulting in bankruptcy, the loss of its business expectancies and the destruction of its business endeavors. Edgar Law Firm negotiated a $6,700,000 settlement for its client.

Fitzgeralds and City of Sugar Creek, Missouri v. Station Casinos. David and the Edgar team represented a gaming company and a municipality in the Kansas City area, bringing suit against the successful applicant for license to operate a riverboat casino in Jackson County. The suit alleged various theories, including tortious interference with the business expectancy, fraudulent concealment and fraud by silence. A settlement was reached, as Station Casinos reported in its public filings with the Securities and Exchange Commission, and Station Casinos paid our clients $38 million.

Jury v. Squire Sanders & Dempsey LLP. David and the Edgar team successfully represented the redevelopers of Kansas City's historic President Hotel in a six-week jury trial against a Cleveland-based law firm, Squire Sanders & Dempsey LLP. Edgar Law Firm negotiated a $43 million settlement for their client.
