On January 5, 2023, the Court granted final approval to a $6,000,000 class settlement on behalf of misclassified California store managers of a national retail chain. The lawsuit filed by Plaintiffs in the United States District Court for the Eastern District of California alleged various claims based on the classification of Plaintiffs, and other Store Managers employed by Defendant in California, as exempt from the California wage and hour laws. Specifically, Plaintiffs’ operative Amended Class Action Complaint asserted ten (10) causes of action for: (1) failure to provide meal periods; (2) failure to authorize and permit rest periods; (3) failure to pay all wages when due; (4) failure to provide accurate itemized wage statements; (5) waiting time penalties; (6) breach of contract; (7) breach of implied covenant of good faith and fair dealing; (8) unlawful business practices in violation of Business and Professions Code section 17200 et seq.; (9) failure to overtime wages; and (10) California Private Attorneys General Act of 2004 (“PAGA”) penalties recoverable for any of the foregoing claims.
